Can Congress Kill the ‘Kill’ Switch? UPDATE January ‘Yes’ List Added – HotAir

This is more than mere speculation, as Congress is the one that let it live. Specifically, 57 Republicans voted in January of this year NOT to turn off development and installation of the obnoxious, Biden administration Big Brother mandate to determine if you were capable of driving your vehicle starting…*checks watch*…THIS YEAR.





Conservatives erupted after dozens of GOP lawmakers rejected an amendment Thursday evening to block funding for a controversial Biden-era vehicle “kill-switch” mandate

GOP privacy hawks warned that failure to block the enforcement of technology that would disable the cars of impaired drivers would grant the government excessive powers over American life. Still, 57 House Republicans joined all but four voting Democrats to tank the amendment in a vote of 164-268.

If the amendment, sponsored by Republican Kentucky Rep. Thomas Massie, had been successful, the $1.2 trillion spending package that cleared the House overwhelmingly on Thursday would have been prohibited from funding the enforcement of a “kill-switch” mandate.

Massie and other conservative lawmakers have sought for years to roll back a provision within former President Joe Biden’s 2021 Infrastructure Investment and Jobs Act (IIJA) that would require the National Highway Traffic Safety Administration (NHTSA) to develop a kill-switch technology for passenger cars. The sweeping infrastructure law passed Congress with bipartisan support.

The IIJA provision calls for the development of impaired driving technology that can “passively monitor the performance of a driver of a motor vehicle to accurately identify whether that driver may be impaired” in passenger cars sold after 2026. The vehicle safety standards agency has yet to require or develop a “kill switch” technology.

So, while articles and safety nazis may downplay and pooh-pooh the advent of such technology, eyeballing your every move in a vehicle you own, privacy and freedom advocates want people to know precisely what a ‘kill switch’ entails.

Ford has reportedly already filed patents for their system.

And with cameras that work on biometrics to decide if you will be allowed to shift your vehicle into drive, what happens if, as in this scenario, there’s been a terrible accident in the back forty with a chainsaw?

Five years ago, maybe I would have still thought this was hyperbole and exaggeration.

But it’s not. It’s also probably not even close to half of what they’re baking into these things.

And also probably why Chip Roy’s amendment to try killing it yet again is doomed, I fear.

However much these craven cowards talk a freedom game, oh, they love a chance to consolidate their power trip so much more. 

Republican Texas Rep. Chip Roy moves to repeal the vehicle “kill switch” mandate amid FISA renewal fight, aiming to reverse the Biden-era policy.

The amendment targets funding tied to the National Highway Traffic Safety Administration (NHTSA) and related highway safety programs, which support the implementation of Section 24220 of the 2021 Infrastructure Investment and Jobs Act under the former Biden administration. Importantly, Roy is pushing for the amendment to be attached to the GOP FISA deal currently being marked up in the House Rules Committee.

The Biden-era “kill switch” provision directs NHTSA to establish a federal safety standard for advanced impaired driving prevention technology — passive systems designed to detect alcohol or other impairment and limit or prevent vehicle operation.

Roy‘s amendment would repeal what some contend is significant government overreach, with the Texas lawmaker lamenting that a faction of GOP members voted against prior legislative efforts to stop funding the requirement of kill switches in new cars. “In January, 57 Republicans joined 211 Democrats to preserve the Biden-Harris mandate requiring kill switches in new cars — a troubling example of government overreach. Americans don’t need Big Brother monitoring them behind the wheel. That’s why I filed an amendment today to kill the kill switch once and for all.”





The potential for mistakes, overreach, and abuse is insane.

…Opponents, including some House Republicans, privacy advocates, and drivers, raise concerns about government overreach, potential false positives that could disable vehicles, privacy implications of driver monitoring, and a lack of recourse if a car shuts down, Kelley Blue Book noted. Critics have cited risks in emergencies or evasive driving situations. The technology applies only to new passenger vehicles manufactured after the effective date of the final standard; it will not be retrofitted into older cars.

NHTSA has acknowledged accuracy challenges, noting that even high detection rates could lead to millions of incorrect interventions annually.

“Currently, detection technology around the legal limit continues to have an error rate that would be unacceptably high … while NHTSA has not made a final determination about the necessary level of accuracy, even a 99.9 percent detection accuracy level could result in millions to tens of millions of instances each year where the technology would incorrectly prevent or limit drivers from operating their vehicles, or fail to prevent or limit impaired drivers from doing so,” the February 2026 Report to Congress reads. “At this time, NHTSA is not aware of any technology that claims to achieve anywhere close to [the needed] level of accuracy.”

The stats according to NHTSA, which combined drinking and drowsiness.

In the U.S., alcohol-impaired driving kills about 11,900–12,400 people annually (e.g., 12,429 in 2023 and 11,904 in 2024), while drowsy driving contributes to thousands more deaths (estimates exceed 6,000 in suspected cases). Together with other impairments, these factors play a role in roughly 30% of traffic fatalities, out of ~39,000–41,000 total annual deaths, according to NHTSA.

How many people are killed or injured specifically because the driver who caused the accident had their head in a cell phone? In 2024, there were 315,167 people injured in distracted driving accidents.

Distracted driving is dangerous, claiming 3,208 lives in 2024. NHTSA leads the national effort to save lives by preventing this dangerous behavior. Get the facts, get involved, and help us keep America’s roads safe.





How many licensed drivers are there in the United States?

Hedges & Company did a statistical analysis in May 2025, updating previous data, to determine there are 242,293,000 licensed drivers in the US. That includes 91% of US residents of driving age. That’s up from 237,656,000 in 2023 and 239,911,000 in 2024.

The number of licensed drivers is projected to grow to 249,051,000 in 2028.

So 11-12,000 drunk driving deaths out of 242+M drivers on the road. Statistically, it’s a minuscule percentage. It’s certainly not if it’s you or yours.

But it is a matter of perspective.

While every life is precious, and every life lost is a horrible tragedy, what do the statistics say about drunk driving in the United States? Do they justify the wholesale government takeover of an American’s personal vehicle in the name of highway safety on the statistically slim chance there may someday be an alcohol related incident?

Since 1982, drunk driving fatalities on our nation’s roadways have decreased 44%, while total traffic fatalities have declined 11%.  Among persons under 21, drunk driving fatalities have decreased 73%.  Despite this progress, we still have more work to do, and our commitment to eliminate drunk driving is stronger than ever. Hardcore drunk drivers continue to wreak havoc on our nation’s road accounting for nearly 67% of drunk driving fatalities, where there is a known alcohol-test result for the driver – a trend that has remained relatively unchanged for more than a decade.

Drunk Driving Fatalities – National Statistics

In 2024, the rate of alcohol-impaired driving fatalities per 100,000 population was 3.5, representing almost a 62% decrease since 1982, when record-keeping began, and a 44% decrease since the inception of The Foundation for Advancing Alcohol Responsibility in 1991. 

Alcohol-impaired driving fatalities accounted for 30% of the total vehicle traffic fatalities in 2024. Between 1991 and 2024, the rate of drunk driving fatalities per 100,000 population has decreased 44% nationally, and 58% among those under 21 between 1991 and 2023. These long-term trends show an overall decline and the gains being made to eliminate drunk and impaired driving, however, our work is not done and it will take everyone and effective and proven solutions.  





‘Hardcore drunk drivers account for nearly 67% of drunk driving fatalities.’ That sounds like a loosey goosey legal system problem to me, and one that does not justify a ‘put Uncle Sam in the driver’s seat’ solution.

It’s exactly the same as taking all the law-abiding gun owners’ weapons away because the psychopathic felon down the street bought a piece on the street and killed a cop.

The vehicle will remain in a Park state and will not allow the shifter to transition into the Drive state.

The future is looking more like a world where you pay for your name and reputation , but everyone else profits off of your private information and influence. 

Surveillance society: It’s not just the new spying tech that’s the problem  – it’s that all older vehicles are being gradually driven off the road and taken out of commission through legislation and a parts shortage, leaving drivers with a hollow choice. 

All is not lost. But we’re not just losing privacy. We’re losing the concept of an exit ramp.
